Transfers IN – From Valid Federal Firearm Licensees 

  1. Transfer Fee is $45 per firearm, per day. $25 for each additional firearm transferred on the same day. Transfer fee(s) covers our handling and receiving of firearm(s) and the FBI NICs 4473 background check for the transfer. Sales tax will be added to the transaction.
  2. We can refuse the transfer of a firearm(s) for any reason, especially if we believe the firearm(s) will be used in an illegal act or for self-harm.
  3. When transferring a firearm(s) through us, you must be legally able to own a firearm(s). Visit the www.atf.gov website for restrictions.
  4. The only person who can receive a firearm(s) ship or delivered to us, is the is the person on the transfer paperwork. The firearm should be ready for pick up 24 hours after delivery. Call 605-561-4867 to confirm your firearm has been delivered and is ready for pick up. 
         a. If you purchase a firearm(s) from another retailer or person, the person who pays for and ships to, is the person who can initiate the transfer of the firearm(s). You cannot purchase firearm(s) from an internet store and ship it to another person. This is considered a “Straw Sale” and is illegal. Visit www.atf.gov website for more information.
         b. If you inherent or gifted firearm(s), you will need to include proper documentation from the estate showing rightful ownership. Visit www.atf.gov website for restrictions.
         c.  If the transfer is between two individuals, both individuals must be present and have documentation of ownership and ID.
  5. You must successfully complete a 4473 form and FBI NICs check. Visit www.fbi.gov/services/cjis/nic for more information. Firearm(s) will not be released without a “Proceed” from FBI NICs. We do not transfer firearm(s) on “Open” “Delay” or “Denied” status.
  6. If you receive a “Denied” or “Open” status from the FBI NICs, the firearm(s) will not be transferred. The firearms cannot be transferred to another person of your choice; this is considered a “straw sale.”
  7. We will hold the firearms for ten (10) days pending an NIC’s appeal. Should a NIC’s appeal not be granted after the ten (10) days, the firearm(s) will immediately be forfeited to us. You will receive no compensation. Internet firearm retailers do not accept returns. We may, at our discretion, elect to consign the firearm(s) for resale.
  8. You have thirty (30) days from the date we receive the firearm to receive a “Proceed” on your 4473 FBI NICs background check. Failure to comply will result in the forfeiture of the firearm to us. You must have written approval from us to extend the thirty (30) day period.
  9. Our FFL is on file at most of the large online retailers. Please call us at 605-561-4867 or email Justin@sturgisguns.com and we will forward our FFL to your preferred retailer.
  10. Do not transfer firearm(s) to us unless you are 100% positive you can successfully receive a “Proceed” on your 4473 FBI NICs check.

Transfers Out – We Ship to Valid Licensed FFL Dealers

When shipping or transferring a firearm out through Sturgis Guns:

  1. Transfer Out Fee is $45 per firearm, $25 for each additional firearm being transferred/shipped. Transfer fee(s) covers our handling and receiving of firearm(s). Shipping fee will be determined by Fed Ex. Sales tax will be added to the transaction.
  2. Present a valid government-issued photo ID acknowledging you are the legal owner of the firearm(s) being transferred and shipped.
  3. Provide a copy of the receiving dealer’s current FFL License, contact information, shipping information, phone number and email address. FFL information will be verified. Verification process times vary. Firearm(s) will not ship until proper verification is received.
  4. Provide name, address, phone number, email address of person receiving firearm(s).
  5. Bring the firearm(s) to us unloaded and properly secured for check-in.
  6. Complete the required Sturgis Guns transfer paperwork with your government-issued photo ID.
  7. Pay the transfer/shipping fee along with any applicable insurance or packaging costs.
  8. We will safely package, log, and ship the firearm only to the designated FFL holder—never to a private individual.
  9. Tracking and confirmation details will be provided once shipped.
  10. The receiving FFL will notify the buyer/recipient when the firearm arrives, and all ATF/NICS requirements must be satisfied before pickup.
  11. If the receiving party cannot successfully complete a 4473 form and the FBI NICs check, firearm(s) will be returned to Sturgis Guns. You will be responsible for all transfer and shipping fees associated with the return of the firearm(s). You will be notified once the firearm(s) is(are) returned to Sturgis Guns. You will have thirty (30) days to complete a 4473 form and the FBI NICs check. Please see our “Transfer In” policies at the beginning of this document.
  12. For out-of-state shipments or special firearms (NFA/Class III), additional regulations may apply, contact us in advance for guidance.

Private Transfers Between Two Parties at Sturgis Guns

  1. Transfer Fee is $45 per firearm, per day. $25 for each additional firearm transferred on the same day. Transfer fee(s) covers our handling and receiving of firearm(s) and the FBI NICs 4473 background check for the transfer. Sales tax will be added to the transaction.
  2. Both parties must come to Sturgis Guns together with a valid government-issued photo ID (driver’s license, state ID, or passport).
  3. Firearm Check-In. The current owner of the firearm(s) brings the firearm(s) to Sturgis Guns, unloaded and secured. We will log firearm(s) into our FFL records.
  4. Bill of Sale (Optional but Recommended). We encourage buyer and seller to bring or fill out a bill of sale for your personal records.
  5. The person receiving the firearm must successfully complete. Please see our “Transfer In” policies at the beginning of this document.
  6. Transfer Fee can be paid by either party and is due at the time of the transaction.
  7. If the firearm(s) cannot be transferred, the original owner of the firearm(s) will be required to complete an ATF Form 4473/NICs Check to take back possession of firearm(s).  See our transfer policies above.
  8. Please make sure both parties can successfully complete a ATF Form 4473/NICs Check before transferring firearm(s).
