STURGIS GUNS TERMS OF SERVICE

These Terms of Service govern your use of the Sturgis Guns website and any purchase, order, transfer, service, or transaction completed through Sturgis Guns. By accessing this website or placing an order, you agree to these terms.

1. Eligibility and Legal Compliance

You must be legally permitted to purchase, possess, receive, and use the products you order. You are responsible for knowing and complying with all applicable federal, state, and local laws.

By placing an order, you confirm that you are not prohibited from purchasing or possessing firearms, ammunition, or any other regulated product.

2. Firearm Purchases and FFL Transfers

Firearms purchased online cannot be shipped directly to a residential address unless expressly permitted by law. Firearms must generally be shipped to a valid Federal Firearms License holder selected by the customer.

The customer is responsible for providing accurate receiving FFL information and confirming that the receiving dealer is willing to accept the transfer before placing an order.

The receiving FFL may charge a separate transfer fee. Any transfer fee charged by the receiving dealer is not included in the purchase price paid to Sturgis Guns.

3. Background Checks and Identification

All firearm transfers are subject to applicable background check, identification, residency, waiting-period, and documentation requirements.

The purchaser must complete all required forms truthfully and must be the actual purchaser of the firearm. Sturgis Guns may cancel or refuse any transaction when required by law or when information appears false, incomplete, or misleading.

4. Age Requirements

Customers must meet all applicable minimum-age requirements. Under federal law, licensed dealers generally may not transfer handguns to individuals under 21 or long guns to individuals under 18. State and local laws may impose additional restrictions.

5. Restricted Products and Locations

Certain firearms, magazines, ammunition, suppressors, accessories, and other products may be restricted in some jurisdictions.

Sturgis Guns reserves the right to refuse, hold, modify, or cancel any order that cannot legally be shipped, sold, transferred, or delivered to the selected destination.

Customers are responsible for confirming that an item is legal in their jurisdiction before ordering.

6. NFA-Regulated Products

Suppressors, short-barreled firearms, and other items regulated under the National Firearms Act may require additional applications, tax payments, approvals, waiting periods, and transfer procedures.

Payment for an NFA-regulated item does not guarantee government approval. Sturgis Guns is not responsible for processing times or decisions made by government agencies.

7. Orders, Pricing, and Availability

All orders are subject to acceptance, product availability, payment verification, and legal review.

We reserve the right to correct pricing, inventory, description, photograph, or typographical errors and to cancel affected orders. If an order is canceled after payment, the applicable amount will be refunded.

Product images are provided for general reference. Actual finishes, markings, packaging, and included accessories may vary by manufacturer or production run.

8. Payment and Fraud Prevention

You represent that you are authorized to use the payment method submitted with your order.

Sturgis Guns may request additional identification or verification before processing an order. Orders suspected of fraud, straw purchasing, unauthorized payment use, or unlawful activity may be canceled and reported when appropriate.

9. Shipping and Delivery

Shipping dates and delivery estimates are not guaranteed. Delays may occur because of carrier conditions, weather, inventory issues, regulatory review, FFL verification, or other circumstances beyond our control.

Customers must inspect non-firearm shipments promptly after delivery and report visible damage, missing items, or shipping errors as soon as possible.

10. Cancellations, Returns, and Refunds

Orders may be subject to cancellation fees, restocking fees, shipping charges, payment-processing costs, or other nonrefundable expenses.

Firearms that have been transferred to the purchaser are generally considered used and may not be returnable. Any firearm defect discovered after transfer may need to be handled directly through the manufacturer’s warranty process.

All returns require prior authorization from Sturgis Guns. Products returned without authorization may be refused.

11. Failed or Denied Transfers

If a firearm transfer is denied, delayed, abandoned, or cannot be completed, the customer remains responsible for any applicable shipping, return-shipping, transfer, restocking, storage, and processing fees.

Sturgis Guns does not control background-check outcomes and does not guarantee that any purchaser will be approved.

12. Product Use and Safety

Firearms, ammunition, and related products can cause serious injury or death if handled improperly. Customers are responsible for safe handling, secure storage, proper maintenance, lawful transportation, and appropriate training.

Always follow the manufacturer’s instructions and all applicable safety rules.

13. Website Content

Website content is provided for general informational and commercial purposes. We do not guarantee that every product description, image, price, availability notice, or technical specification will be completely error-free.

Nothing on this website constitutes legal advice.

14. Limitation of Liability

To the fullest extent permitted by law, Sturgis Guns will not be liable for indirect, incidental, special, consequential, or punitive damages arising from website use, product use, shipping delays, transfer denials, third-party services, or unauthorized or unlawful conduct.

15. Indemnification

You agree to indemnify and hold harmless Sturgis Guns, its owners, employees, agents, and service providers from claims, losses, liabilities, expenses, or damages arising from your violation of these terms, unlawful conduct, misuse of a product, or violation of another person’s rights.

16. Changes to These Terms

Sturgis Guns may update these Terms of Service at any time. Updated terms become effective when posted on this website. Continued use of the website after an update constitutes acceptance of the revised terms.

17. Governing Law

These terms will be governed by the laws applicable in the State of South Dakota, without regard to conflict-of-law principles, except where federal law controls.
